EQUIPMENT RENTAL AGREEMENT & LIABILITY WAIVER — Power Move Properties LLC, 100 Andrews St, Bristol, CT 06010. Equipment: Future FT15 (1-Ton) Mini Excavator, Serial 251024260 (agreed replacement value $5,000). Rate: $175/day (2-6 days $150/day; weekend $275; week $600), due in full at pickup. Refundable $300 deposit before release, returned within 7 days if the equipment comes back undamaged; late return accrues rental PLUS $200/day. Delivery $150 within 20 miles of Bristol (round trip) plus $4 per additional round-trip mile; optional operator $100/hr (4-hour minimum). Renter accepts the equipment as-is in good condition and returns it cleaned and refueled, in the same condition. Use only for its intended purpose, safely and lawfully, by trained, sober, authorized operators 21+; no subletting; do not remove from Connecticut or modify without written consent; do daily fluid/condition checks and stop if unsafe. RISK OF LOSS: From pickup until return, Renter bears ALL risk of loss, theft, vandalism, and damage regardless of cause (except Owner's gross negligence or willful misconduct), and pays repair cost or the full $5,000 replacement value if lost, stolen, or destroyed. INSURANCE: Owner's insurance does NOT cover Renter or Renter's use. RELEASE & INDEMNITY: Heavy equipment is inherently dangerous (tip-overs, crushing, struck-by, utility strikes). To the fullest extent permitted by Connecticut law, Renter assumes all risks, releases Power Move Properties LLC and its members, managers, and employees from claims for injury (including death) or property damage arising from Renter's use, and agrees to defend and indemnify them, except for loss caused solely by their gross negligence or willful misconduct. Rented AS IS with no warranties. Governed by Connecticut law; venue in the Judicial District of New Britain; prevailing party may recover reasonable attorneys' fees.
